1. Introduction

These Terms and Conditions (hereinafter: the "Terms") govern access to and use of the website swisspayments.ch (the "Website") and any services provided by Swisspayments, a company incorporated under Swiss law, registered under number CHE-492.759.632

With its registered address at Rue du Mont-Blanc 11, 1201 Geneva, Switzerland (hereinafter: "Swisspayments", "we", or "us").

Swiss Payments is affiliated to SO-FIT as a financial intermediary within the meaning of article 2 para. 3 of the Anti-Money Laundering Act (AMLA). SO-FIT is a self-regulatory organization recognized by the Swiss Federal Financial Markets Supervisory Authority (FINMA). SwissPayments is not a bank and does not hold a banking license.

Swisspayments operates as a virtual asset-related services (VASP), in compliance with Swiss financial regulations.

2. Acceptance of Terms

By accessing this Website and using any services offered by Swisspayments, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must refrain from using the Website or any associated services.

3. Services Provided

Swisspayments provides secure and compliant digital infrastructure for merchants, including:

  • Payment gateway solutions
  • Fraud prevention systems
  • Crypto and fiat payments (via third-party regulated providers)
  • Tokenization of real-world assets
  • Transaction monitoring dashboards and analytics tools

All services are delivered either directly or in cooperation with duly authorised financial partners. Swisspayments does not hold client funds and does not engage in banking activities under the Swiss Banking Act (Art. 1 para. 2 BA).

4. User Eligibility & Onboarding

Access to services is subject to:

  • Completion of a Know-Your-Customer (KYC) verification process
  • Successful Anti-Money Laundering (AML/CFT) checks
  • Risk assessment and internal approval by Swisspayments

Users must provide accurate and complete information at all times.

5. Prohibited Use

Users are strictly prohibited from using Swisspayments's services for purposes that include but are not limited to:

  • Money laundering, terrorist financing, or sanctions evasion
  • Transactions related to illegal goods or services.
  • Fraudulent activities or market manipulation
  • Using services in violation of Swiss or international law
  • Misuse or compromise of system integrity.

Swisspayments reserves the right to refuse, suspend, or terminate accounts without notice in the event of suspected unlawful use.

6. Regulatory Compliance

Swisspayments is subject to and complies with all applicable Swiss regulations, including:

  • Anti-Money Laundering Act (AMLA)
  • FINMA Anti-Money Laundering Ordinance (AMLO-FINMA)
  • Swiss Data Protection Act (rev. FADP 2023)
  • Financial Services Act (FinSA), where applicable
  • Rules and guidelines issued by SO-FIT, our supervisory OAR

All transactions may be monitored and reported in accordance with Swiss AML rules.

7. Liability Disclaimer

Swisspayments endeavours to ensure uninterrupted access to its Website and services, but cannot guarantee availability at all times. Swisspayments shall not be held liable for:

  • Service interruptions (maintenance, security incidents, force majeure)
  • Loss of data or content due to third-party actions
  • User negligence, including credential mismanagement.
  • Financial or reputational damage resulting from misuse of the platform.

Users accept that access and use of services are at their own risk.

8. Intellectual Property

All intellectual property on the Website — including trademarks, logos, source code, text, and media — are owned by Swisspayments or licensed third parties. No content may be copied, reproduced, or redistributed without prior written consent.

10. Governing Law and Jurisdiction

These Terms are governed by Swiss law. Any dispute arising from the use of Swisspayments's services or Website shall fall under the exclusive jurisdiction of the ordinary courts of Geneva, Switzerland, unless mandatory legal provisions stipulate otherwise.
